This privacy policy (“Privacy Policy”) applies to the Personal Information collected by Dash Social when you interact with our Website, Services, or personnel. The Privacy Policy describes what information we collect and why we collect it, how we use that information and when we disclose it, and how you can exercise your privacy rights.

Our Website and Services are designed for our business Customers only. We do not offer products or services for use by individuals for their personal, family, or household purposes. Accordingly, we treat all Personal Information we collect as pertaining to individuals in their capacities as representatives of the relevant Customers and not in their individual capacities.

These terms shall have the following meanings within this Privacy Policy (these terms will apply whether used in a singular or plural and upper case or lower case):
“Customer” means any organization or business that is a Customer of Dash Social, has purchased the Dash Social Service, and has authorized its users to engage on the Platform.
“Creator” means any individual, entity, or other organization (other than Dash Social and its Affiliates), and their respective Affiliates or agents, that are engaged to create promotional media content for a Customer through the Services, including without limitation social media influencers.
“Personal Information” means any information that can be used to identify you.
“Platform” means Dash Social’s online, web-based platform and mobile application.
“Third-Party Platform” means a third-party social platform such as Facebook, Instagram, Pinterest, X, TikTok, LinkedIn, YouTube, etc.
“Services” means the Platform and the related services provided by Dash Social to its Customers.
“We”/”Us”/”Our”/”Dash Social” means Dash Hudson Inc. and our affiliated companies.
“Website” means https://www.dashsocial.com and any linked webpages hosted by us.
“You”/”Your” means individual users, your organization, or the individual whose Personal Information is being processed.
Scope of this Privacy Policy
This Privacy Policy applies to the Personal Information collected during the course of Dash Social’s relationship with you, including when you engage with our personnel, or use our Services or Website. For the purposes of this Privacy Policy, Dash Social is the controller because we are responsible for deciding how your Personal Information is processed.
This Privacy Policy does not apply to Personal Information that Dash Social processes on behalf of its Customers. In those instances, our Customers are the controllers of the Personal Information and their privacy policies (rather than this Privacy Policy) will apply to the Personal Information they upload and store in our Platform, as well as any Personal Information they may process from public sources through Customer’s use of the Platform. Dash Social’s processing activity as a service provider and processor is governed by the contracts we have with our Customers, including our Terms of Service.
It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing Personal Information about you so that you are fully aware of how and why we are using your information. This Privacy Policy supplements the other notices and is not intended to override them.
Please note that information about Creators that Dash Social receives from Customers, or otherwise processes on Customers’ behalf, in connection with the Services provided by Dash Social to Customers is processed by Dash Social in accordance with a data protection agreement and the privacy policies of the applicable Customer who is the ‘data controller’. Accordingly, this Privacy Policy is subject to such agreements. In addition, if you are a Creator, you acknowledge and agree that we may share your Personal Information collected through the Platform and through use of the Service with the applicable Customer. Any information that we may provide to any Customer and the Customers’ use of such Creators’ information is not subject to the terms of this Privacy Policy. Instead, such use is subject to separate agreement between Customer and Creator, and Dash Social does not control any use, disclosure or other processing of Creator related-information and other data by Customers. Children Under the Age of 16
Please note that Dash Social does not direct any of its business practices, including its Website and Services, directly or indirectly towards children. We are committed to respecting the online privacy of children and ensuring that Dash Social is compliant with all applicable laws. No one under age 16 may provide any Personal Information to or on our Website. We do not knowingly collect Personal Information from children under 16. If we discover that we have collected and stored Personal Information from a child under 16 without parental consent, we will promptly delete that information. If you believe we may have any information from or about a child under 16, please contact us.
Third-Party Websites
The Website may include links to third-party websites, plug-ins, and applications. Please note that this Privacy Policy does not apply to Personal Information that is processed when you access third-party websites through our Website. Third-party websites are governed by their own terms and privacy policies which will explain how your Personal Information is used. When you leave our Website, we encourage you to read the privacy notice of every website you visit. Dash Social accepts no responsibility or liability for third party websites.
The Personal Information that we collect about you may be provided directly to us by you, obtained automatically based on your interactions with our Website and/or Services, or provided to us from other individuals, organizations, users, or other third parties. Dash Social does not collect any sensitive Personal Information about you and the terms that govern your use of the Services prohibit you from providing Dash Social with sensitive Personal Information (as that term is defined under applicable law).
If you fail to provide necessary Personal Information
Where we need to collect Personal Information by law, under the terms of our contract with you, or to facilitate the provision of the Services, and you fail to provide that information when requested, we may not be able to provide you with our Services. If this is the case, we may need to terminate our Services with you.

Notwithstanding the above, we may use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law.
Our policy is to not give, sell, or otherwise distribute the Personal Information we collect to third parties outside of Dash Social unless we have your express consent. However, an exception applies to the parties listed below, circumstances where the third party is a service provider for us or our Services or Website, or when deemed necessary and in accordance with applicable law.

Google Integration
Dash Social uses Google APIs to provide Google Drive, Google Sheet, and Big Query integration features, including permitting Dash Social to send and receive data reports directly to and from the Customer’s Google accounts. If Customers choose to connect their Google account to the Platform, Customers are authorizing Dash Social to edit, create, and delete only the specific Google files that Customers use within the Platform.
Dash Social also uses Google APIs to provide a Google email integration feature within the Platform. To the extent that you or your employer elect to connect the Platform to a Gmail account, Dash Social will also process email messages. This integration allows you to compose and send email messages within the Platform. Dash Social then imports replies to such messages into the Platform. Our use of Personal Information is further limited by the “Additional Limits on Use of Your Google User Data” section of this Privacy Policy.
Dash Social’s use of information obtained from Google APIs will adhere to the Google API Service User Data Policy, including the Limited Use Requirements. Additionally, Dash Social does not use Google Workspace APIs to develop, improve, or train generalized AI and/or ML models.
This Google integration will not share the data with Google’s third-party AI models.
Additional Limits on Use of Your Google User Data
Notwithstanding anything to the contrary in this Privacy Policy, if you provide the Dash Social access to your Google user data, Gmail (read, write, modify, and control), Dash Social’s use of such data will be subject to these additional restrictions:

For the avoidance of doubt, the additional restrictions contained in this section shall only apply to Gmail data received through the Google OAuth API, to the extent such use is applicable to you.
YouTube Integration
Dash Social uses YouTube API Services as a service provider, and if you use these services through the Service, you are agreeing to be bound by YouTube’s Terms of Service and you are subject to the Google Privacy Policy. Notwithstanding the above, we may share information that does not identify you (including information that has been aggregated or de-identified) except as prohibited by applicable law. For information on your rights and choices regarding how we share information about you, please see the “Your Legal Rights” section below. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
We have put in place appropriate security measures to prevent your Personal Information from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your Personal Information on our instructions and they are subject to a duty of confidentiality.
We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

We will only retain your Personal Information until it is no longer necessary for the purpose for which it was collected, for legitimate business purposes, or to comply with our legal obligations.

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it in accordance with our data retention policy, or, in the limited circumstances where this is not possible (for example, because your information has been stored in backup archives), then we will securely store your information and isolate it from any further processing until deletion is possible.
In accordance with applicable data protection laws, you may exercise certain rights over your Personal Information, which may include the right to request access, correction, or deletion of the Personal Information held about you, the right to limit the use or disclosure of your Personal Information, and/or the right to withdraw consent for processing. You also have the right to opt out of future marketing emails by using the “unsubscribe” link at the bottom of Dash Social’s marketing email communications. Note that if you submit a request to delete your information, this may prohibit you from using the Service. If you have authorized us to access your data via the YouTube API Services, then in addition to our normal procedure for deleting stored data, you may revoke our access to your data via the Google security settings page, located at https://security.google.com/settings/security/permissions.
We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
Please note that to protect your Personal Information, we may request specific information from you to help us confirm your identity and your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.
In providing our Website and Services, the Personal Information that we collect will be processed, stored, and used in the United States and in other jurisdictions. This may result in transfers of Personal Information outside of your country of residence.
Dash Social complies with the EU-U.S. Data Privacy Framework (the “EU-U.S. DPF”), the UK Extension to the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework (the “Swiss-U.S. DPF”) administered by the U.S. Department of Commerce (collectively referred to herein as the “Data Privacy Frameworks”). The Data Privacy Frameworks address how we handle the collection, utilization, and retention of Personal Information transferred from the European Union, the United Kingdom, and Switzerland to the United States whether through our Website or in connection with providing the services or operating and administering our business.
Dash Social has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (the “EU-U.S. DPF Principles”) with regard to processing Personal Information received from the European Union in relation to the EU-U.S. DPF and from the United Kingdom in reliance on the UK extension of the EU-U.S. DPF. Dash Social has also certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (the “Swiss-U.S. DPF Principles”) with regard to the processing of Personal Information received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In the event that Dash Social engages third party agents to process Personal Information on its behalf, Dash Social shall be responsible for ensuring that the processing is done in accordance with the applicable Data Privacy Frameworks. As noted in Section 6, Dash Social may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security, public interest, or law enforcement requirements. The Federal Trade Commission has jurisdiction over Dash Social’s compliance with the EU-U.S. DPF, the UK extension of the EU-U.S. DPF, and the Swiss-U.S. DPF. If you have a complaint that Dash Social cannot resolve, Dash Social cooperates with JAMS, an alternative dispute resolution provider, for resolving disputes. The services provided by JAMS are at no cost to you. Pursuant to the DPF Principles, you may be permitted to invoke binding arbitration to address the complaint. Dash Social will cooperate with the appropriate data protection authorities during the investigation and resolution of complaints.

To exercise your rights, you can submit a request to compliance@dashsocial.com and include “CALIFORNIA PRIVACY RIGHTS” in the subject line. Residents of California may do so for Personal Information collected in the last 12 months. You may also opt out of the sale or sharing of your Personal Information by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). Please note that by selecting to use the GPC signal, you will need to turn it on for each browser.
Identity Verification - To process your request, we may need to verify your identity and retain the right to confirm your California residency. Generally, we will verify your request by asking you to provide specific information which will allow us to verify and confirm your identity. The information you provide in a consumer request will only be used to verify your identity.
Authorized Agent - You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.
